1. Agreement to Terms
By accessing or using MyDayRate, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the service.
2. Use of Service
MyDayRate is a platform that connects customers with tradespeople. By using our service, you agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account
- Notify us immediately of any unauthorized use of your account
- Not use the service for any illegal or unauthorized purpose
- Not interfere with or disrupt the service or servers
3. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our service.
You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password.
4. Bookings and Payments
All bookings made through MyDayRate are subject to the following terms:
- Day rates are set by individual tradespeople and may vary
- To confirm a booking, customers pay an 8% booking deposit based on the agreed total cost
- The booking deposit is collected through our secure payment system at the time of booking
- The tradesperson is paid directly by the customer for the work — MyDayRate does not handle the tradesperson's payment
- The 8% booking deposit is generally non-refundable, except in certain circumstances outlined in our Cancellation and Refund Policy below
5. Tradesperson Obligations
If you register as a tradesperson, you agree to:
- Provide services professionally and competently
- Maintain all necessary licenses and insurance
- Respond to booking requests in a timely manner
- Complete work as described in accepted proposals
- Comply with all applicable laws and regulations
Important: It is the sole responsibility of customers to vet tradespeople and confirm that they hold all necessary and valid insurances, qualifications, licenses, and accreditations required for the work to be performed. MyDayRate does not verify or guarantee the credentials, qualifications, or insurance status of any tradesperson listed on the platform. Customers should request and verify proof of insurance, qualifications, and relevant certifications before engaging any tradesperson for work.
6. Cancellation and Refund Policy
MyDayRate operates as a connection platform between customers and tradespeople. Our cancellation and refund policy is as follows:
- The 8% booking deposit is generally non-refundable once a booking is confirmed
- The booking deposit may be refunded at MyDayRate's discretion in the following circumstances:
- The tradesperson does not show up for a confirmed booking without valid justification
- The tradesperson cancels the booking before the scheduled start date
- Other exceptional circumstances as determined by our support team
- Since the tradesperson is paid directly by the customer, any payment disputes for the work itself must be resolved between the customer and tradesperson
- We recommend discussing cancellation terms with your tradesperson before booking
- If you experience any issues, including no-shows, please contact our support team immediately for assistance
7. Limitation of Liability
MyDayRate acts as a platform to connect customers and tradespeople. We are not responsible for:
- The quality of work performed by tradespeople
- Any damage or injury resulting from services provided
- Disputes between customers and tradespeople
- Loss of data or interruption of service
8. Intellectual Property
The service and its original content, features, and functionality are and will remain the exclusive property of MyDayRate and its licensors. The service is protected by copyright, trademark, and other laws of both the country and foreign countries.
9. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
